‘I don’t have that kind of money’: Carollo reacts to federal judge’s ruling denying new trial, reduction in $63M verdict – WSVN 7News | Miami News, Weather, Sports

Coconut Grove, Fla. ,

The commissioner spoke with 7news on the camera on Thursday, in which he commented on the phone before night.

“I am very happy. There was no surprise in the judge’s decision, ”he said.

Carolo strongly stated the US District Judge Rodney Smith, saying that he would not do a new test to the commissioner or reduce his multi-dollar decision.

“We knew how he was going to rule, but before the federal laws, before we could appeal, we had to present the proposal to him,” Carolo said.

Back in June, a Forte Loddel Jury found Carolo responsible for violating the rights of Little Havana Hotspot Ball and Chen, William Fuller and Martin Pinila. As a result, the commissioner was ordered to pay a total loss of $ 63.5 million.

In this latest, 13-page judgment, Smith wrote that “the functions of the defendant specifically targeted the financial weaknesses of the plaintiff ‘, or by trying to shut down their tenants’, targeted businesses, businesses. The defendant’s actions were constant and incredible. And the action of the defendant was deliberately and malicious.”

Carolo’s lawyer argued that there were clear errors with the test and the disadvantages were excessive.

But Smith rejected the argument, writing in his judgment, “The defendant argues that the disadvantages respected are so extremely excessive that they shock the conscience. The court disagrees. The only setback for Vivek here is that the defendant used his status and power to make the city government a weapon against the plaintiff as the plaintiff chose to use his first amendment rights by supporting the defendant’s political rival. ,

To pay that decision, the American Marshals has already started the process of seizing Carolo’s property, recently advertising a public auction to sell its coconut grove house.

“I’m going to get 10% of 10% $ 63, still interest, attorney fees? It is $ 70 million or more; I do not have that kind of money, and they know, “Carolo said,” So that’s all they are doing this: to try to see how they can pressurize me. ,

Carolo said that his legal team’s next steps were to stop the auction and try to appeal for new tests.
