Attorney for man accused in deputy’s death asks judge to throw out 2 statements given to authorities

Summerville, W.V.

Brent Tyler Kelly (WVRRJA)

29 -year -old Brent Tyler Kelly of Birch River was designed to go on a trial on 2 April, but Webster County Circuit Judge Jack Alsop prosecuted on July 23 at a hearing earlier this week at Samarsville earlier this week.

The allegations against Kelly include murder, two cases of murder attempt, four cases of pride crisis and a count of a conspiracy, alleging that Kelly knew that Richie Halkomb, the person who was allegedly shooting at the police, was stopped from keeping a gun.

Baker was shot dead during a firing near RV that Kelly and Halkomb were using in the Birch river area.

Kelly’s Attorney, Robert McCoid, argued the two pretial movements this week. He wants Alsop RV’s police discovery to suppress and suppress two statements given to the police. One of those statements came to the State Police Headquarters in Summersville at the night of shooting. Another statement was given to an ATF agent by Kelly, who interviewed Kelly in South Central Regional Jail.

Alsop heard testimony on both the movements this week. He gave 15 days to the Nicholas County Prosecutor to reply. There will be 15 additional days after defense to respond to the prosecutor’s arguments.

During the preliminary hearing of August 2022, a soldier of a state police testified that evidence revealed that Kelly had a gun bullet on his hands, face and forehead, but under the cross-exam, Troper admitted that Agar Kelly had fired a bullet during a two-plus hour-long deadlock.

Halkomb, who died inside RV, died of an AR -15 with a self -affected gun pellet wound. Suicide was confirmed by the State Medical Examiner’s Office. It was bullets from the AR -15 that claimed the life of Baker.

In each count of prosecution, words said that Kelly worked in a concert with Halkomb in committing crimes.

Kelly remains in South Central Regional Jail without bail.
